Recently, Supreme Court Judge Justice Prashant Kumar Mishra successfully began the discourse of the importance of fraternity as a constitutionally mandated value of India and those hate politics are destroying that fraternity as well as the unity of the nation. He was addressing the national council meeting of the Akhil Bharatiya Adhivakta Parishad in Gujarat&rsquo;s Kheda district, where he spelt out how religion, caste and ethnicity have become political tools. Justice Mishra added those identity-based politics albeit in rare moments, give voice to voiceless minorities, The majority of the time, the politics cause exclusion, and discrimination and perpetuate divisions. &ldquo;When political leaders harness social identities for votes, this goes against the vision of belonging presented in the Constitution,&rdquo; he said. The use of technology and social media in sharing hate speech, fake news, and polarizing information added to it, he noted. Justice Mishra also focused on income disparity and social discrimination as the major obstacles on the way toward fraternity. He urged lawmakers, civil society and citizens to adopt a complex approach to closing existing social divides. The notion that laws should defend not only rights but also social order as well as tackle systematic prejudice was commented on by him. He pointed out that, to be effective the judiciary also has a responsibility to maintain fraternal values by actively embracing, mediation, reconciliation and enforceable legal procedures. &ldquo;The language of judgments should be in line with the fraternal spirit of the fraternity and be easily understood by the public,&rdquo; he added. Mr Justice Mishra, therefore, summed up the symposiums by saying that fraternity was the golden cord that remained as the string that can hold the ideals of liberty, equality and justice forever.
